Mayor Fitch called the meeting to order at 6:00 p.m. Notice of meeting and agenda
were posted
on the City Hall notice board as required by law.

The Mayor and Council convened in executive session at 6:01 p.m. and reconvened in
regular,
open session at 6:48 p.m. Roll call reflected all members present.
1. Pursuant to Section 307B.2, Title 25, Oklahoma Statutes,
consider convening in executive
session to discuss (1) negotiations for a Collective Bargaining Agreement for FY 2009-2010,
between the American Federation of State, County and Municipal Employees (AFSCME) Local
3894, and the City of Lawton and (2) a June 28, 2010 interest arbitration decision issued by a
neutral arbitrator, and, if necessary, take appropriate action in open session. Exhibits: None.
Jensen read the title of item 1. He stated that as the City Attorney,
he has advised the City
Council that they cannot legally award a contract based upon this arbitration award during this
fiscal year for the arbitration award for an agreement last fiscal year. He is stating that under
both Oklahoma Statutes and the Oklahoma Constitution they cannot legally do that.
MOVED by Drewry, SECOND by Tenis, to adopt Resolution 10-63 rejecting both a request for
funding and a request for approval necessary to implement the June 28, 2010 arbitration decision
between AFSCME Local 3894 and the City of Lawton for the fiscal year 2009-2010 contract for
the reasons specified in the resolution. AYE: Zarle, Shoemate, Tenis, Drewry, Fitch. NAY:
Haywood, Wells, Burk, Shanklin. MOTION CARRIED.
There being no further business to consider, the meeting adjourned at 6:51 p.m. upon
motion,
second and roll call vote.
